I was listening to the new OTEP CD here recently, and I think she made a song about Luka...what she'd like to do to him.

Judge, courtroom availability key factors

Luka Magnotta's murder trial is set for Sept. 15, 2014. Although that date is more than two years after his arrest in connection with the death of Jun Lin, that is not an unusual amount of time for a high-profile murder case to reach the trial stage.Some have questioned why it takes so long for cases like Magnotta's to get to court. Lukatrial.com, for example, the popular website that has been following the case from the beginning, says, "I will never understand how we can delay justice for so long in a case like this."
The key determinant in most cases has to do with judicial resources, rather than issues related to the defence or the prosecution.

Ottawa criminal lawyer Ian Carter told CBC News that the 16-month delay between the preliminary hearing and Magnotta's trial before judge and jury is not unusual. A trial like Magnotta's "is normally set that far in advance because they need to find a courtroom and a judge."The Magnotta trial is expected to last six to eight weeks, a relatively big block of court time. The court facilities, the judge, the lawyers and the witnesses all need to be available at the same time, and there are always other trials in the queue competing for timeslots.In the Magnotta case, his lawyer, Luc Leclair, had requested an earlier start date — April 2014 — but last week Justice Andre Vincent said September was the earliest possibility. "It's a busy courthouse," Leclair told reporters, adding, "I'm not completely surprised."

Reasonable time

There are others factors as well that play a role in setting the date. The starting point is the Charter of Rights and Freedoms, which states, "Any person charged with an offence has the right ... to be tried within a reasonable time."Section 11 of the Charter is also the one that says anyone charged should "be presumed innocent until proven guilty." A defendant who is to be tried by a superior court judge alone or a judge and jury usually has the right to a preliminary hearing. Magnotta's wrapped up April 12 with an order to stand trial for first-degree murder and four other charges. Carter says Magnotta's preliminary hearing happened relatively quickly. "In terms of judicial resources, there's a longer period of delay from the initial charge to the preliminary inquiry than there is between the preliminary and the superior court trial."

"Technically, the preliminary is there to serve as a screening mechanism to see if there is some evidence of the offence you've been charged with, [but] in the vast majority of cases there's no argument about committal to stand trial," Carter said. Where that does happen, sometimes, is in murder cases, with an argument over whether the charge should be first- or second-degree murder or manslaughter. Leclair argued unsuccessfully that Magnotta should be tried for second-degree. However, Carter explained that the reality with preliminary inquiries is that, "In the vast majority of cases it's used by the defence as discovery-type process, to get information about certain parts of the crown's case," and to get an idea of how witnesses will perform in the courtroom.

Janitor from Luka Magnotta’s Building Testifies

The janitor who worked at Luka Magnotta’s building when the grisly murder occurred, took the stand at the accused murderer’s preliminary hearing today.

Michael Nadeau appeared somewhat nervous as Crown attorney Louis Bouthillier questioned him.

At one point during the janitor’s testimony, Magnotta’s face turned red and he dabbed his eyes, bowed his head and rested his head on his chin..

Later in the day … testimony by a bloodstain expert caused the father of Jun Lin, Diran Lin to become faint and stumble out of the courtroom.

Three Montreal Police Officers Take the Stand at Magnotta Hearing before a Two Week Break

Wearing an unbuttoned, short-sleeved plaid shirt with a white undershirt and white pants, a shackled and handcuffed Magnotta listened to testimony Wednesday from three Montreal police officers who specialize in extracting digital information from cameras, computers, cellphones and online.

Constable Nadine Paoliello wrapped up her testimony, which was interrupted Tuesday when Magnotta collapsed and the hearing was adjourned for the day. Sgt.-Det. Panagiotis Sarganis, a computer forensic specialist from the Montreal police force, also testified, as did Constable Frank Massa. Several videos were shown throughout the morning.

Close Friend of Victim Jun Lin Testifies

A close friend of Jun Lin testifying Monday at the preliminary hearing of Luka Magnotta asked that his name not be made public because he is “between jobs.”

But Quebec Court Judge Lori-Renée Weitzman rejected the request from Dong Dong Xu, 30, the 26th witness to testify at the hearing as it resumed Monday after a one-week break.

A publication ban still remains in effect on all the evidence heard at the preliminary hearing – a routine order from the court at this stage of the proceedings.

As has been the case since the hearing began March 11, many spectators lined up early in order to get one of 24 seats reserved for spectators.

Magnotta’s lawyer argues for second degree murder, not first degree

If Luka Rocco Magnotta is ordered to stand trial, it should be on a charge of second-degree murder and not first-degree, one of his lawyers said Monday.

Luc Leclair told court he intends to make final arguments to that effect later this week as Magnotta’s preliminary inquiry wraps up.

Magnotta, 30, is charged with first-degree murder in the death of Chinese engineering student Jun Lin. He has pleaded not guilty and opted for trial before a judge and jury. A trial likely wouldn’t be heard until 2014.

The Crown says only one more witness might appear at the hearing. After closing arguments, a judge will have to decide whether Magnotta’s case should be sent to trial.

On Monday, the proceedings resumed after a two-week break. Witnesses included Montreal’s Dong Dong Xu, a man described as a good friend of Lin’s, as wel as people who appeared from Vancouver via a video link.

Xu answered questions from Crown and defence lawyers as Magnotta listened impassively. Xu, 30, attempted to have a publication ban placed on his identity, but the judge dismissed the request.
