"Merely viewing Web images of child pornography does not, absent other proof, constitute either possession or procurement within the meaning of our Penal Law," Senior Judge Carmen Beauchamp Ciparick wrote for a majority of four of the six judges.

Thats how it is in most states... it's a waste of money to lock people up for viewing images anyway.

Agree, I am just disgusted. In 20 years pedophiles will come out saying that what they do isn't wrong, hell the media in all forms does a good job of this already.

I encountered this same thing in my career. I was able to provide detailed time stamped logs which included a history of a thumbnail of the offending images being first displayed followed up by the fullsize version of the picture (showing intent to view at that point - can't argue it was just on the screen and I didn't mean to see it). I was also able to provide camera evidence with timestamps matching timestamps of the access logs after I setup a camera to determine who was viewing the child pornography as it was a workstation in a common use area. Once I had the evidence and an identity to associate it with, I went to my higher ups who essentially refused to act because the individual in question made the company a lot of money. The evidence was 100% concrete and indisputable and they did nothing. I was more or less threatened to "let it go" or be shown the door if I took it to the police after I expressed my extreme distaste for their lack of action. Well, I don't work there any longer and the police also did jack shit.

Who in the hell would WANT to look at it? It may be legal as the article suggest, but it's still sick.
