Congressional Hearing on HB 194
On Monday, May 7, 2012, U.S. Senator Dick Durbin (D-IL), held a congressional hearing at the Carl B. Stokes United States Court House in Cleveland. This hearing examined the impact of HB 194, which restricts early voting, eliminates the requirement that poll workers direct voters to the proper precinct, and makes it harder to vote absentee. Senator Sherrod Brown (D-OH) joined Durbin at the hearing and the ACLU offered testimony on the negative impact HB 194 would have on Ohio elections.

OLUMBUS, Ohio - Ohio lawmakers on Tuesday repealed a controversial election bill that was supposed to go before voters on Nov. 6 -- the first known case in Ohio history in which legislators repealed a bill up for referendum.

Outnumbered Democrats unanimously opposed the repeal of House Bill 194, a GOP-backed election law passed last year that restricts early voting and makes several other changes. They said it subverts Ohio citizens' constitutional right to referendum.

"By taking the action that we're proposing to take today, we discourage people in the future from taking advantage of the initiative and referendum right," Rep. Dennis Murray, a Democrat from Sandusky, said on the House floor. "This goes fundamentally to the question of who it is in this state that holds the power of government. I think that's the people of this state, and I think the action we're taking today violates the constitution."

The GOP-controlled House of Representatives passed the bill, Senate Bill 295, by a vote of 54-42. The bill now goes to Gov. John Kasich for his signature. A spokesman for the Republican governor has said Kasich will sign the bill, meaning the rules for the presidential election will be identical to those in place for the primary in March.
