Executive Order forces citizens to turn over all gold to the federal reserve, prohibits ‘hoarding’

Recently, upon modifying President Bill Clinton’s 1994 Executive Order 12919 which was based on the The Defense Production Act (DPA) of 1950 (50 U.S.C. Appx § 2061 et seq.), President Barack Obama captured the paranoia of the citizens, many of whom had previously never given much thought to what exactly an executive order is, the constitutionality of them, or the content of those issued going back to President Lincoln during the Civil War.

Sadly, it is unknown to the majority of Americans that this presidential tradition is technically an overstepping of the powers granted to the Executive Branch, as outlined in Article II of the Constitution. What is even more frightening are the powers that former (and current) Presidents have granted themselves, mostly in the name of national security or ‘continuity of government’ during a national emergency. Making the matter worse, the definition of national emergency is so vague that theoretically it could mean just about anything. I don’t know about you, but when the federal government can seize the nations food, transportation, factories, farms, water, medicine, and property while controlling where the citizens work and where they can travel, I would like to have a clear definition of what constitutes an emergency.Then again, the order Obama issued on March 16th, 2012 applies during non-emergencies as well, so I guess it is a moot point anyway.

Part 2, Section 201 (b)

… shall plan for and issue regulations to prioritize and allocate resources and establish standards and procedures by which the authority shall be used to promote the national defense, under both emergency and non-emergency conditions.

The U.S. Constitution is absolutely clear without any ambiguity what so ever in the fact that only Congress has the exclusive right to enact all law.

Article I, Section 1. “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

So I read the provisions of the XO, it states that Banks MUST pay full going rates for gold....

This is great as usually when I sell it is to a broker who wants a fee.

You can't eat gold but I don't think it's right of the govt. to seize people's gold.
