I don't think you need to be charged with a crime these days. You can be detained for as long as they want without arrest, accusation or trial. He's a suspected terrorist because he served in the military. Our Constitution is being ignored by our Constitutional Lawyer President. Very sad.

Most States have a law where you can be held for observation for three days. All it takes is an arbitrary judgement call by a local police officer.
The moment they check you into the ward you can ask for a medical release form and sign it stating you want to check yourself out. That starts the countdown whereby within 5 days they must release you, or get a judge to committ you.
If they want to hold you longer than 3 to 5 days they have to take you to court and get a Judges order for committment.
To do that they need to evaluate you.
To do that they need you to open your mouth and talk.
If you keep your mouth shut you get out in three to five days as long as you don't exhibot any violent, suicidal, or homicidal behavior.
Unfortunately for Raub he could not keep his mouth shut and the Psychiatric Staff are very creative when it comes to interpreting anything you say into making it sound like your crazy.

Then again there is one more possibility.
Did he deliberately try to cause just enough trouble for the sole purpose of creating a lawsuit, without actually breaking any law?
If so some folks just got p owned.
If he proves he only exercised his 1st amendment rights. Did not at any time threaten any person or property.....he has a suit that can get pushed all the way up.
I often wonder about that angle on a lot of these stories. I know some people who have constant lawsuits going for all kinds of things.

I am in no way defending the actions of anyone that was a party to his 'detention', but this happened in Virgina just a few miles from my home.
We had the Virginia Tech massacre which happened because the individual was not subject to an evaluation when he had been recommended to be by a university psychiatrist--the university intervention team thought they were powerless to intervene.
This is the reactionary response to his posts driven into a state of over sensitivity because we all remember the day of the massacre here.
I never cried so hard as that day and my wife had Virgina State Police CAD up on her laptop showing the names of the murdered days before they were made public and which trooper was going to who's home to give the devastating news--I couldn't bring myself to look for fear of seeing a family name I knew.
This is an over reaction in my opinion, but as I said, the memory and hurt is still too recent for any possibility of it happening here again to be overlooked.
If you must, hate my message, not me for stating what is fact here.
In the end each other is all we have.

That is not the case in his case. His family knew what he was doing and why he was doing it and agreed with what he was doing.
In fact they worked together on materials he was using on his Facebook page.
His Mother and Brother being Interviewed.

I'd really like to see this semi-nude pics. He's kinda cute. The only pics I saw showed him shirtless.
And now that he is locked up in a psychiatric ward they will give him a diagnosis about his fixation to posting these references online and determine that he might pose a danger to himself, or others because he made the mistake of opening his mouth and trying to explain it to them when what he should have done was kept his mouth shut insisting he would speak to a psychiatrist as an outpatient once they released him after their three day hold. Now that he opened his mouth a judge will committ him and he is stuck for 30 days after which they may decide to keep him longer. The longer your in the harder it is to get out.
All because he could not keep his mouth shut because he was proud of what he was doing on FaceBook and wanted everyone to hear about it thinking it would all make sense to them and they would give him a pat on the back and send him home.
I can guess they will likely be writing in his notes that he has delusions of grandeur for sure since he said he will be leading the revolution. Thats a no brainer and enough to keep him right there.
