"You Been Owned" Federal Case
http://www.youvebeenowned.org/
Have you guys heard about this? Am I posting old crap or is this really under the radar like the person that sent it to me says??
Corporations have really lost their f*cking minds.
Quote:Do you really own the smartphone or computer you’re using to read this? If you sold your books, would you be breaking the law? A federal court in New York says you would be, even if you legally paid for and bought them.
It's unbelievable, but trademark and copyright holders really are trying to use a legal loophole to take away your right to sell things that you own: Please add your name at right to fight back.
Public interest advocates are taking the case all the way to the Supreme Court, and Demand Progress is joining up with a coalition of groups -- including many of those that came together to kill SOPA -- to support the rights of ordinary Internet users and everyday consumers.
We are working to defend a long-standing principle known as the "First-Sale Doctrine." This common-sense rule gives us the right to sell most property we own, but big businesses have been trying to chip away at out our rights in the courts. If the Supreme Court supports the lower court’s decision, we won't really “own” anything if any part of it was made in a different country. And practically anything you own -- from your iPod to your house -- could have been made abroad, in whole or in part.
We only have a few months to make our voices heard before the Supreme Court makes a lasting ruling. We are asking President Obama and the U.S. Department of Justice to stand up for the little guy: The President can urge the Court to side with consumers, but he'll only do it if we bring enough pressure to bare.
If we lose this fight, practically anybody who wants to resell products they bought -- from Macbooks and iPhones to our clothing and textbooks -- will have to ask copyright holders for permission first. And they'll have the right to deny it!
It's bad for so many reasons: It'll undermine Craigslist and Ebay, hurt the environment, increase incentives for manufacturers to move jobs off-shore, and effectively ban the traditional American yard sale. For more info, please check out Marvin Ammori's article about the lawsuit.

RE: "You Been Owned" Federal Case
I signed it about an hour ago.
CRAZY!!!!!! People will still sell THEIR property. what are going to have? A used electronic administration like the DEA trying to find people who sell their used stuff? We already have a useless war on drugs, people would go underground with it. Actually, I don't think people would buy anything new in the first place. Way to help the economy.
What about returning it to the store if you don't like it? Would you have to get their permission to do that too?

I swear if I had the money I'd leave the US. Each law seems to be dumber than the previous.

Yeah, I saw it on Rivero's site a couple nights ago. Insanity plain and simple.

RE: "You Been Owned" Federal Case
It started with the ban on the sale of used toys a couple of years ago.
Now Goodwill and Salvation Army do not sell toys. It is actually illegal to sell them at yard sales but no one has been selected as an arrest/ test court case.

RE: "You Been Owned" Federal Case
Let's just do this the easy way...DON'T buy the products these companies sell, until they stop this "illegal reselling of their products" crap.
Buy their competitor's products instead, and send them a letter telling them exactly why you didn't buy their miserable product in the first place.
Once the $$$ stops flowing in and these companies start feeling the pinch, maybe they'll stop messing with the American citizens' right to buy and sell legally purchased products as they choose.

I actually think that it's a good thing for government to legislate themselves out of existence.

RE: "You Been Owned" Federal Case
Interesting. No one in this area, including politicians & law enforcement abides by these rules. Probably because they would have 20+ towns in this area alone who would fight back if they ever actually enforced this crap.

TOTALLY out of control.
If this becomes law, I'd suggest anything you're done with, instead of trying to re-sell it, pack it right full of the nastiest stinkiest most vile poo you can find and ship it back to the greedy bastards that think THEY own it... with a note: "Here's your SHIT back a-holes... LITERALLY!"

I can't say whether or not they sell toys, but I can tell you that I volunteered with an organization up until a year ago which sold them at their thrift. What happened was that regulation was passed where it became increasingly difficult to determine what, and what we weren't supposed to sell. Also, the implication was that we could be held liable for defective products. As far as I am aware, they are still selling toys, but some items are just not accepted anymore. In the instance of car seats, which was passed several years ago, we just ended up giving them away. Too many needy parents and grandparents on fixed incomes needed them.
