Trump allies raking in tens of thousands of dollars from wealthy felons seeking pardons: NYT

"According to a report from the New York Times, close associates of Donald Trump have been raking in tens of thousands of dollars from wealthy felons seeking a presidential pardon before the president steps down next week.

In his waning weeks in office, the president has been pardoning close associates who were either facing criminal charges tied to his 2016 election or were already serving time.

According to the latest report from the NYT's Michael Schmidt and Jonathan Vogel, based on documents and interviews with more than three dozen lobbyists and attorneys, the market for pardons has increased ever since it became apparent the president would be leaving office.

"The pardon lobbying heated up as it became clear that Mr. Trump had no recourse for challenging his election defeat, lobbyists and lawyers say," the report states. "One lobbyist, Brett Tolman, a former federal prosecutor who has been advising the White House on pardons and commutations, has monetized his clemency work, collecting tens of thousands of dollars, and possibly more, in recent weeks to lobby the White House for clemency for the son of a former Arkansas senator; the founder of the notorious online drug marketplace Silk Road; and a Manhattan socialite who pleaded guilty in a fraud scheme."

The report also notes that Trump's former personal attorney, John Dowd has been "marketing" himself to potential clients seeking pardons and that former New York City Mayor Rudy Giuliani also has been implicated.

"A one time top adviser to the Trump campaign was paid $50,000 to help seek a pardon for John Kiriakou, a former C.I.A. officer convicted of illegally disclosing classified information, and agreed to a $50,000 bonus if the president granted it, according to a copy of an agreement," the Times is reporting. "And Mr. Kiriakou was separately told that Mr. Trump's personal lawyer Rudolph W. Giuliani could help him secure a pardon for $2 million. Mr. Kiriakou rejected the offer, but an associate, fearing that Mr. Giuliani was illegally selling pardons, alerted the F.B.I. Mr. Giuliani challenged this characterization."

According to Margaret Love, who worked on clemency issues in the Justice Department from 1990 until 1997, "This kind of off-books influence peddling, special-privilege system denies consideration to the hundreds of ordinary people who have obediently lined up as required by Justice Department rules, and is a basic violation of the longstanding effort to make this process at least look fair."

The Times reported that the White House had no comment when asked about the allegations."

John Kiriakou, who was jailed in 2012 for identity leak, said his pursuit of a pardon came up in a meeting with Giuliani last year

"An associate of Rudy Giuliani told a former CIA officer a presidential pardon was “going to cost $2m”, the New York Times reported on Sunday in the latest bombshell to break across the last, chaotic days of Donald Trump’s presidency.

The report detailed widespread and in some cases lucrative lobbying involving people seeking a pardon as Trump’s time in office winds down. The 45th president, impeached twice, will leave power on Wednesday with the inauguration of Joe Biden.

The former CIA officer John Kiriakou, who was jailed in 2012 for leaking the identity of an operative involved in torture, told the Times he laughed at the remark from the associate of Giuliani, the former New York mayor who as Trump’s personal attorney is reportedly a possible pardon recipient himself.

“Two million bucks – are you out of your mind?” Kiriakou reportedly said. “Even if I had two million bucks, I wouldn’t spend it to recover a $700,000 pension.”

An associate of Kiriakou reported the conversation to the FBI, the Times said.


Meant to reward offenders who show contrition, presidential pardons do not imply innocence. Presidents often use them to reward allies but Trump has taken the practice to extremes.

Among recent recipients of pardons or acts of clemency are Michael Flynn, Trump’s first national security adviser who pleaded guilty to lying to the FBI about contacts with Russia; the political dirty trickster Roger Stone, who did not turn on Trump during the Russia investigation in which he was convicted of obstructing Congress; Paul Manafort, Trump’s former campaign manager convicted in the Russia investigation; and Charles Kushner, father of Trump’s son-in-law Jared Kushner who was convicted of tax fraud and witness retaliation.

The Times report detailed an “ad hoc” White House system for approving pardons which it said was run by the younger Kushner, bypassing the usual “intensive justice department review process intended to identify and vet the most deserving recipients from among thousands of clemency applications”.

The report also identified lobbyists it said were seeking pardons on behalf of fee-paying clients. It is not illegal to do so.

Margaret Love, who was the United States pardon attorney at the Department of Justice for seven years, told the paper: “This kind of off-books influence peddling, special-privilege system denies consideration to the hundreds of ordinary people who have obediently lined up as required by justice department rules, and is a basic violation of the longstanding effort to make this process at least look fair.”

Trump will lose legal protection once he leaves office and faces threats both potential and already in train. He has reportedly discussed issuing pre-emptive pardons to himself, Kushner, Giuliani and other family members and close aides. It is not clear whether a self-pardon would work."

Trump 'spooked' away from pardoning his children and pro-insurrection lawmakers: report

"During a lengthy meeting with his legal advisers, President Donald Trump was swayed away from pardoning his children as well as Republican lawmakers who encouraged insurrectionists at the Capitol on Jan. 6.

According to CNN.com, Trump along with Ivanka and Jared Kushner listened in as White House counsel Pat Cipollone and Eric Herschmann that the only way he could pardon himself, his family and the GOP members was if he listed out the crimes that were committed. Listing the crimes in the pardon would essentially give prosecutors a guide for how to charge the Trumps with state or civil crimes, which don't fall under the pardon.

While it was something that Trump has discussed with his legal advisers along with former Attorney General Bill Barr, this time Trump finally got the message.

"President Donald Trump last week commuted the prison sentence of a man named Fred Davis Clark, Jr., who in 2015 was convicted for crimes related to a $300 million dollar Ponzi scheme.

Now the Tampa Bay Times reports that one of the man's victims, a Trump supporter named Kimball Pugmire, is not happy with the president's decision.

Pugmire lost his entire life savings thanks to Clark's Ponzi scheme, which the United States Department of Justice says "involved sales at Cay Clubs Resorts and Marinas... to approximately 1,400 investors in the Florida Keys and elsewhere."

New report reveals multiple GOP lawmakers sought pardons for their roles in the Capitol riot

"With President-elect Joe Biden's inauguration ceremony less than 24 hours away, reporters have been wondering who President Donald Trump will grant pardons to during his remaining time in the White House. And according to CNN's sources, Trump has decided against granting them to GOP lawmakers who spoke at or helped put together his "Save America Rally" in Washington, D.C. on Jan. 6.

That rally took place before a violent mob of far-right extremists and Trump supporters stormed the U.S. Capitol Building. The U.S. House of Representatives has since indicted Trump on an article of impeachment for "incitement to insurrection."

In an article published by CNN's website the day before Biden's inauguration, reporters Kaitlan Collins, Kevin Liptak and Pamela Brown explain:

"Several Republican lawmakers who are alleged to have been involved in the rally that preceded the deadly riot on the U.S. Capitol have sought clemency from Trump before he leaves office. But after meeting with his legal advisers for several hours on Saturday, the president decided he would not grant them, according to two people familiar with his plans."

The CNN reporters add, "The fear of legal exposure is not limited to Republicans who promoted or spoke at the rally, including Reps. Andy Biggs, Mo Brooks and Paul Gosar. Those who participated, organized and fundraised for it are also concerned, sources told CNN, including his eldest son, Donald Trump, Jr., and his girlfriend, Kimberly Guilfoyle, who both spoke at the rally."

The report doesn't explicitly specify which Republican lawmakers sought out the pardons. But it's noteworthy that any feel pardons for their conduct would be necessary. Some Democrats have suggested that Republican members of Congress may have had even more insidious roles in the attack than organizing or speaking at the rally that helped fuel the attack; they have indicated that some Republicans may have even played a part in planning the invasion of the Capitol Building itself, though it's not clear what evidence for these claims exists."

So no self pardon because it was not in his best interests legally in charges pending and no pardon for his family members because that would make them more likely to testify against him.

Other allies of Trump who have received pardons in the final weeks of his presidency include former campaign adviser George Papadopoulos and lawyer Alex van der Zwaan, who both pleaded guilty to lying to the FBI during special counsel Robert Mueller’s investigation into Russian interference in the 2016 election.

Rep. Adam Schiff (D-Calif.), chair of the House Intelligence Committee, denounced Trump’s decision to pardon Manafort, calling the president “lawless until the bitter end.”



Along with Trump’s pardoning of corrupt, criminally convicted political allies, the president granted perhaps his most shocking pardons on Dec. 22 for the four former Blackwater security contractors involved in the killings of more than a dozen unarmed Iraqi civilians in 2007. The 14 civilians who were killed included a medical student and his mother, as well as a man whose arms were raised when Blackwater agents opened fire on him, according to U.S. federal prosecutors. Others were killed as Blackwater agents fired on their vehicles while they attempted to flee, according to The Washington Post.

Nicholas Slatten, Paul Slough, Evan Liberty and Dustin Heard were convicted on murder and manslaughter charges in 2014 after a monthslong trial in federal court in Washington. After they received their pardons, Faris Fadel, the brother of slain Iraqi civilian Osama Abbas, called Trump’s decision “unfair.”

These pardons Presidents give out, any President, are there any kinds of rules or restrictions on them? For example since he was still alive when Obama left office, could Obama have pardoned Charles Manson? (Not that he would have, but just to use an over the top example).
