Trump has attempted to put his personal reputation, and that of his family above the law, and the country, which I personally view as a violation of his oath of office.

US Courts have been consistent in maintaining that NDAs cannot prevent an employee from reporting illegal conduct and aiding agency investigations. The National Labor Relations Board holds that non-disparagement clauses, as well as clauses that attempt to prevent employees from discussing with their co-workers the terms and conditions of their job, conflict with the rights of workers to engage in concerted activity.

Which essentially is what Bolton case is attempting to do.

In a more simplistic explanation, Trump is using NDA's to engage in witness tampering with the unspoken threat that speaking against Trump will result in civil litigation.

You're right and the consequences can destroy a long career and leave you broken and broke.
Putting aside the delaying accusations by Democrats even if the court rule in favor of Congress and an appeal court too the witness could always pull a Cory Lewandowski.

I'm curious on the status of Bolton's Security Clearance and if it was denied and then given to him by Trump would it be valid now that he's out of the Trump administration?

Remember. He was previously an Undersecretary of State from 2001-2005 under Bush, and it is likely that even after 12 years, he probably still had a number of security clearances sitting on the books.

I wonder how any of this would have played out over the last few years if Trump was a Democrat, and installing Democrat judges across the nation? CNN would be praising the economy. They would be kissing his ass like Obama's ass, and asking for immigration control. Hate goes a long way in politics, just don't forget to kiss babies during photo ops.

They explicitly state in the complaint that they weren't a direct witness to MOST of the events.

Thereby they were a direct witness to one or more of the events in the complaint.

They also stated that they were one of the non-White House officials who received a printout of the Trump/Zelensky call.

This all comes down to a case of Self Incrimination of sorts.

As an employee of the Executive Branch, the argument is:

Bolton risks prosecution/penalization for breaking Executive Privilege, which in turn could cost him his Security Clearance.

and

Bolton risks prosecution/penalization for defying a Congressional Subpoena.

It basically becomes a Damn if you do/Damned if you don't scenario, so it has been presented to a Federal Judge to make a Separation of Powers ruling.

It seems Bolton and Kupperman want to testify but also want a court ruling first, to clear them in case the white house sues them or Barr's DOJ decides to prosecute them for some rule or law violation.

The former national security adviser has been called to testify in the impeachment inquiry by lawmakers, but his lawyers want a court to clear him to do so first.

"President Donald Trump’s former National Security Adviser John Bolton knows about “many relevant meetings and conversations” surrounding Trump’s communications with Ukraine, Bolton’s lawyer told lawmakers Friday.

Bolton has information that House impeachment investigators do not know about yet, his lawyer said in a letter to the chief House lawyer, according to the New York Times. Lawmakers have called on Bolton to testify as part of the impeachment inquiry, but his lawyer first wants a court to rule on whether he should be made to do so, given that the White House has chosen not to cooperate with the inquiry.

HuffPost reached out to his lawyer, but did not immediately receive a response.

Bolton did not show up Thursday for his deposition by lawmakers in the impeachment inquiry. He is one of several current and former Trump administration officials who have failed to appear for their closed-door depositions.

Bolton, who was fired in September, would be a key witness in the impeachment inquiry into Trump’s pressure campaign on Ukraine to investigate former Vice President Joe Biden, one of the Democratic frontrunners for 2020, and his son Hunter.

According to reports in October, Bolton was at one point so concerned about Trump’s personal lawyer Rudy Giuliani’s efforts to pressure Ukraine for political help that he ordered an aide to warn White House attorneys about Giuliani’s behavior.

Lawmakers released testimony Friday from closed-door depositions with the aide in question, Fiona Hill, a former White House policy adviser on Russia, as well as Army Lt. Col. Alexander Vindman.

Both Hill and Vindman raised concerns about Trump’s dealings with Ukraine, saying that officials conditioned a White House meeting with Ukrainian leaders on whether or not the country launched an investigation into Biden, and implicated acting White House chief of staff Mick Mulvaney in this quid pro quo.

Hill and Vindman also testified that Bolton cut short a July meeting between officials from the Trump administration and from Ukraine, after the U.S. Ambassador to the European Union Gordon Sondland began speaking of Ukraine conducting these investigations in order for the country’s president, Volodymyr Zelensky, to get a meeting with Trump.

The House Intelligence, Oversight and Foreign Affairs committees will be hosting the inquiry’s first public hearings next week, when three State Department officials who have already privately spoken with investigators will testify."
