This all comes down to a case of Self Incrimination of sorts.

As an employee of the Executive Branch, the argument is:

Bolton risks prosecution/penalization for breaking Executive Privilege, which in turn could cost him his Security Clearance.

Bolton risks prosecution/penalization for defying a Congressional Subpoena.

It basically becomes a Damn if you do/Damned if you don't scenario, so it has been presented to a Federal Judge to make a Separation of Powers ruling.

It seems Bolton and Kupperman want to testify but also want a court ruling first, to clear them in case the white house sues them or Barr's DOJ decides to prosecute them for some rule or law violation.

"The attorney representing both former national security adviser John Bolton and former acting national security adviser Charles Kupperman indicated on Friday that both of his clients are willing to testify in the impeachment inquiry against President Donald Trump, according to CBS News reporter Rob Legare.

In a letter to House of Representatives General Counsel Douglas Letter, attorney Charles Cooper writes that both Bolton and Kupperman are ready “to testify if the Judiciary resolves the conflict in favor of the Legislative Branch’s position respecting such testimony.”

Cooper goes on to write that Democratic lawmakers “are mistaken” for saying that this deference to the judiciary is merely a stalling tactic intended to get his two clients off the hook for testifying.

“If the House chooses not to pursue through subpoena the testimony of Dr. Kupperman and Ambassador Bolton, let the record be clear: that is the House’s decision,” he says.

Judge Leon seems to want to issue a ruling in the Kupperman case anyway, per @joshgerstein, even though the House withdrew its subpoena. Leon: “it is critical, in my judgment, that this matter remain on track.”

The case could set a precedent in favor of congressional subpoenas.

Pay attention, Bolton is already a has been and now has a conflict of interest against the Trump administration. He can do very little damage, if any to Trump.

Normally, you Dems chase after little red balls. This is not a little red ball where Trump says "Fake News", it's actual business. The results are clearly great for America. Trump completely destroyed that strategy. That strategy can not be re-implemented in our lifetime friend.

Bolton knows about meetings not yet investigated, lawyer says
The attorney stressed the importance of Bolton’s appearance before impeachment investigators.

Cooper also represents Charles Kupperman, Bolton’s former deputy, who had asked a federal court whether he was required to comply with a subpoena seeking his testimony. The White House stepped in to block Kupperman from testifying, and Democrats believed they would have done the same for Bolton. The House withdrew the subpoena for Kupperman this week.

The leaders of the three House committees leading the impeachment inquiry decided on Thursday that they would not issue a subpoena to Bolton, effectively giving up on securing his testimony. Bolton was due to appear for a deposition Thursday, and Cooper informed the committees that his client would challenge a subpoena in court.

A House Intelligence Committee official called Bolton’s posture a delay tactic, and said investigators had no interest in entertaining a months-long court battle. Instead, the official said, Bolton’s refusal to testify would be used as evidence against President Donald Trump of obstruction of Congress.

Several current and former White House officials who have already testified before impeachment investigators have described Bolton as a key witness to the events surrounding Trump’s efforts to pressure Ukraine’s leaders to investigate his political rivals. He at times described Trump’s personal lawyer Rudy Giuliani as a “hand grenade,” and said acting White House chief of staff Mick Mulvaney was involved in a “drug deal” involving potentially withholding critical military aid from Ukraine and refusing a White House meeting between the two presidents."

Bolton quit because of Trump's Putin pandering and traitorous actions. Bolton was not let go. Trump has not got out of Syria but he tried to do Putin's bidding in getting out then realized he looked too stupid and Putin pandering, so now he moved the troops from Syria to Iraq and is protecting the Kurds oil and the money from that oil is going to go to the Kurds and some profits going to international oil companies.

Bolton can bring Trump down I expect with the information he has on Trump's strange actions doing everything Putin wants him to do. The American people do not trust Trump or Putin and they are not going to allow a traitor like Trump a second term.

"Former National Security Advisor John Bolton told a federal judge on Monday that his interests do not align with those of acting White House chief of staff Mick Mulvaney.

“A long-simmering feud within the White House broke into the open on Monday as a lawyer for John R. Bolton, President Trump’s former national security adviser, filed a motion trying to keep Mick Mulvaney, the president’s acting chief of staff, from joining a lawsuit over impeachment testimony,” New York Times chief White House correspondent Peter Baker reported Monday.

The lawsuit was filed by former Deputy National Security Advisor Charles Kupperman, who asked a judge to decide whether he should abide by a congressional subpoena or obey Trump’s edict to stonewall Congress.

“Mr. Bolton’s lawyer argued in court papers that Mr. Mulvaney should not be allowed to jump into the existing lawsuit as a plaintiff because his interests are significantly different,” The Times reported. “But the legal schism underscored a broader rift between Mr. Mulvaney, who facilitated Mr. Trump’s effort to pressure Ukraine for damaging information about Democrats, and Mr. Bolton, who tried to resist it.”

Bolton and Kupperman were both reportedly “flabbergasted” that Mulvaney attempted to join the lawsuit.
