Supreme Court rules US requirements on overseas NGOs do not violate free speech

The Supreme Court ruled on Monday that Congress can require that foreign affiliates of U.S. groups fighting AIDS overseas explicitly oppose prostitution and sex trafficking as a condition for receiving federal funding.

The 5-3 decision, written by conservative Justice Brett Kavanaugh, broke along ideological lines, with the court's liberal spam issuing a dissenting opinion. Justice Elena Kagan recused herself due to her previous involvement in the issue as solicitor general under President Obama.

The justices previously ruled in 2013 that the funding requirement violated the First Amendment when it applied to U.S. nongovernmental organizations (NGOs) engaged in the global fight against HIV and AIDS.

Several American NGOs then filed a second lawsuit seeking to have those protections extended to their foreign partners.

But the majority rejected that argument in a 9-page opinion on Monday, finding the so-called policy requirement did not run afoul of the Constitution.

"The Court’s prior decision recognized the First Amendment rights of American organizations and held that American organizations do not have to comply with the policy requirement," Kavanaugh wrote. "This case instead concerns foreign organizations that are voluntarily affiliated with American organizations.

"Those foreign organizations are legally separate from the American organizations," he continued. "And because foreign organizations operating abroad do not possess constitutional rights, those foreign organizations do not have a First Amendment right to disregard the policy requirement."

The law in question — a 2003 statute known as the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act — originally said only U.S. NGOs with “a policy explicitly opposing prostitution and sex trafficking” were eligible for funding, before that provision was struck down.

In a dissenting opinion on Monday, Justice Stephen Breyer said the majority incorrectly treated U.S.-based NGOs and foreign affiliates as separate entities, when in fact the former merely "speak[s] through clearly identified affiliates that have been incorporated overseas."

"The court, in my view, asks the wrong question and gives the wrong answer," he said. "This case is not about the First Amendment rights of foreign organizations. It is about — and has always been about — the First Amendment rights of American organizations."

Breyer's dissent was joined by Justices Ruth Bader Ginsburg and Sonia Sotomayor.

What is all this anger and opposition to prostitution? It's not necessarily associated with "sex trafficking", whatever that is by current definitions!

Men have a right to negotiate for and pay for sex with a willing participant. We have a right to expect it by contract(marriage, etc.). What does this have to do with George Soros who is promoting communism and chaos throughout the world?

Not exactly a win; only applies to Soros' foreign NGO affiliates, his US NGO remains unaffected.

All they have to do is sign the Policy Requirement, which is bizarre, because US NGO's don't have to follow the same requirements.


Supreme Court decides Soros Funded Open Society's foreign affiliates do not have First Amendment rights or any constitutional rights

In 2003 the Congress passed "The leadership Act" to fight againts HIV/AIDS, Tuberculosis and Malaria globally. Congress has allocated billions of dollars to American and foreign nongovernmental organizations that combat HIV/AIDS/Tuberculosis and Malaria abroad. Congress only funds those who have or agree to have "a policy explicitly opposing prostitution and sex trafficking" This is known as the Policy Requirement.

It's worth to note American NGOs are not required to follow this Policy Requirement because they are protected by First Amendment.

This Soros funded NGO is located in the USA and they've been receiving funds from "The leadership Act" but they have refused to agree to policy of eradicating prostitution and sex trafficking and they can do so because First Amendment protects them as they are officially an american NGO. However what George Soros attempted to do here was extend First Amendment to apply all his other NGOs around the world which fight againts HIV/AIDS/Tuberculos and Malaria. He argued that they are part of his american NGO and therefore should have same kind of protection under constitution. So again why did he want to do this? Because his foreign NGOs refused to agree to "Policy Agreement" to eradicate prostitution and sex trafficking. Because they are foreign NGOs, they are forced to agree to "Police Agreement" or else they won't get any funding(or this is how it was supposed to be but because lower courts decided otherwise, they've been waiting for Supreme Court's decision) Can you believe Corrupt SDNY and U.S. Court of Appeals for the Second Circuit actually agreed all Soros NGOs in foreign countries are protected by the constitution of the United States?

So the Supreme Court decided today his foreign NGOs are not protected by the constitution of the United States because foreign people or foreign NGOs located outside the USA can't possibly enjoy the rights of the american people. One of his NGOs being located inside the USA did not justify giving the same rights to his foreign NGOs.
